Do I Need Permission to Sell Brands Online?
This is a major concern for anyone who wishes to start its
online business, having a broad vision. And most of the online businesses are
started by reselling the brand items. So, what do you think, do you need permission
to sell branded products?
The large brands aren’t quite happy with the e-commerce
business model. This needs competitive discounting, and which is subtracting
their profits. Also, they still have to honor the warranty to keep their worth,
so these are the reasons they’re struggling to keep their existing physical
shop network happy. But now, they can’t ignore online shopping either as this
is the era of e-commerce. Some 45 million of people in Middle East countries

No, not at all! Who
can think that a company will not want its products to be sold? According to
the laws, this is a matter to be settled and well discussed between the Brand,
the sellers, and the distributors. You may remember Lenovo and Toshiba warning
their consumers against purchasing heavily discounted products. A well-known
company SanDisk, also said that it was going to manage and control its online
reselling channel by only allowing the authorized sellers to sell all of its
products. Thus, there are a lot of brands whose permission you will need in
form of license, for reselling, but most of such brands would easily let you
just sell their products online.
Note that, however, the law does not take kindly to
deception. So, if you’re selling Sony or Toshiba products online at your website,
and your website is totally occupied with their logos everywhere, which may
make the buyer think that the seller is the company itself. And then, the
authorized sellers or Sony or Toshiba itself would take an action. In such
cases, you will need an authorization certificate or just, going tricky
anonymously. But if wish to go the legal way, and you are buying original
products from a Sony or Toshiba distributor, there is no requirement placed by
the law on the seller to get an authorization certificate. It is dependent on
the company itself.
There are a lot of issues while doing a business
online, selling the products to well-reputed brands. The major issue that
occurs most of the time is the warranty scheme. Most of the distributors sell
you the branded products but they keep the warranty terms hidden from you. And
later on, when you need to get a warranty claim for your customer, these
distributors do not offer you the warranty claim or demand a handsome amount
for this purpose. So, it is up to you to properly discuss the matter with your
distributor in order to keep your business running flawlessly, and avoid the
law pursuits.
